BasketMedia — Terms of Service
These Terms of Service (“Terms”) are an agreement between you and Chandmani Technology LLC, the company that operates BasketMedia (“BasketMedia”, “we”, “us”), a basketball news, live score, video and statistics service based in Ulaanbaatar, Mongolia. They cover the BasketMedia mobile application and the website at https://basketmedia.mn (together, the “Service”).
By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for it.
2. Your account
- You may register with an email address or with Facebook Login. The data we receive from Facebook Login is described in section 2.1 of our Privacy Policy.
- You must give accurate information and keep it up to date.
- One person may hold one account. Accounts are personal and may not be sold, shared or transferred.
- You are responsible for everything that happens under your account and for keeping your credentials secure. Tell us immediately at ch.byambabayar@gmail.com if you suspect unauthorised use.
- You may delete your account at any time, as described in section 7 of the Privacy Policy.
3. Acceptable use
When using the Service you agree not to:
- Post content that is unlawful, abusive, hateful, defamatory, obscene, or that harasses or threatens others.
- Impersonate another person, or misrepresent your affiliation with any person or organisation.
- Upload malware, attempt to gain unauthorised access to the Service, or interfere with its normal operation.
- Scrape, copy, redistribute, rebroadcast or resell content from the Service, including video and live streams, without our prior written permission.
- Use bots, automated scripts or multiple accounts to manipulate comments, rankings or any other part of the Service.
- Use the Service for any purpose that is unlawful under the laws of Mongolia or of your own country.
We may remove content, suspend or terminate an account that breaches these rules, and where necessary report the matter to the authorities.
4. User content
You keep ownership of the comments and other content you submit. By submitting content you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display and distribute it within the Service for as long as you keep it posted. You confirm that you have the rights to the content you submit. We do not pre-moderate user content and are not responsible for it, but we may remove content that breaches these Terms.
5. Our content and third-party content
The Service, including its design, text, graphics, logos and software, is owned by BasketMedia or its licensors and is protected by copyright and trademark law. News articles, statistics, images, video and live streams may come from third-party sources and remain the property of their respective owners; they are provided for personal, non-commercial viewing only. Team and league names and logos belong to their owners, and BasketMedia is not affiliated with, endorsed by or sponsored by the NBA or any league, team or player.
The Service may link to third-party websites and services. We do not control them and are not responsible for their content, terms or privacy practices.
6. Availability and changes to the Service
We work to keep the Service available, but we do not guarantee uninterrupted access. Features, content and live streams may be changed, suspended or withdrawn at any time, including for maintenance, licensing reasons or technical limits.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections 4, 5, 8, 9 and 10 survive termination.
8. Disclaimer
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Scores, statistics, schedules and news are provided for information only; we do not warrant that they are accurate, complete or current, and you should not rely on them as your sole source for any decision.
9. Limitation of liability
To the fullest extent permitted by law, BasketMedia is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or loss of goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to MNT 100,000.
10. Governing law
These Terms are governed by the laws of Mongolia. Disputes that cannot be resolved between us will be submitted to the competent courts of Ulaanbaatar, Mongolia.
11. Changes to these Terms
We may update these Terms. When we do, we will change the “Last updated” date on this page and, where the change is material, notify you in the app. Continuing to use the Service after a change means you accept the updated Terms.
